(2) Entspricht die Leistung des Auftragnehmers den Vereinbarungen, erklärt der Auftraggeber unverzüglich, gegebenenfalls nach erfolgter Güteprüfung, schriftlich die Abnahme.
(3) Wird die Abnahme der Lieferung oder Leistung nicht schriftlich erklärt, so gilt sie mit der Schlusszahlung als bewirkt.
